San Jose: Judge John Pasco ruled that a Seeing Eye dog couldn't be considered a passenger and fined Sherman Hill $115 for driving alone in a freeway car-pool lane.
"Hill, of San Francisco, told the judge he was blind in his left eye and partially blind in the right," reported the San Francisco Examiner. "He said his dog, Queenie, sits on his lap and barks when there is a car in front of his. Pasco ruled that the dog was not a person under California Vehicle Code section 21655.5 as it applies to commuter lanes..."
Hill reportedly accelerated and changed lanes to avoid the CHP on the Montague Expressway before he and Queenie were stopped.
"Hill told the officer he was speeding up to cool off his dog."
