Well, I think the lawyers start from that default position of they were just reporting what the wackos were saying because it was "newsworthy" and that FOX was not saying it just allowing Trump's lawyers to come on the air and say it because they were the president's lawyers. 

That did not fly the first time around, during discovery it was shown FOX employees and their on air entertainers were promoting the lies while knowing they were lies. So, they can start with that defense again but this is going to go in the same direction. 

It probably takes some time before we see how losing these/having to settle shakes out for them. 

It would have been amazing if it went to trial and we got to see scum like Carlson and Hannity having to get on the stand and admit they knew they were promoting lies but FOX having to settle says the same thing...just without the fun of seeing them sweat more.
