The answer is Hostile Workplace!!!
It doesn't matter WHY (in the eyes of the law) an image bothers you, If it bothers you, he must take it down. If he refuses...and especially if there are reprecussions against you because of it...then you have grounds for a hostile workplace suit against him.
So, case in point. Let's say I'm the owner of a small auto shop. I have a pic of the latest "Snap On Tools" girl on my calendar. I hire a female transmission specialist who states that she doesn't appreciate the pic. If I don't take it down, I'm in big trouble. If I do...at that point, I can work something up in my policy that protects her from the offending image but still allows me to keep my calendar up...say...putting it in the Mens room rather than over by my tool box.
Remember, it doesn't matter WHY it offends you. If it bothers you, have it removed.
