His re-sentencing of this guy was not of his choice there Green Sewer. His hand was forced and if you are telling me that the Corrections Department was hancuffing Cashman I say Bullshit.
Can you see it there, Corrections would have released this sex offender in order that he get treatment(agin not the Judges fault), which in his case was only available on the outside(agin not the Judges fault). What you don't have here is the fact that he could have received treatment in jail but because of the rules mentioned here in terms of this offenders classification(agin not the Judges fault), AND, because our legislature had not authorized monies so that an offender of his classification could receive treatment in prison(agin not the Judges fault).
Strange but the Judge never mentioned that. Hmnn I guess he as too busy making quotes about "Not believing punishment".

Since this brouhaha broke, the legislature has made moneys available so that this dubious treatment can occur, in jail, for an offender of his classification; and the offender, has been resentenced accordingly(the Judges doing).

Judge Cashman, quite apart from O'Reilly or WCAX, took a calculated risk and sentenced in accordance with what was actually going to transpire due to legislative rule making. I believe he did it to illustrate for the public the shortcomings of the rules he is bound to follow but did not create, in hopes of nudging the legislature to fix this problem they inadvertently created.

If it were up to me, I would solve this problem one offender at a time as they crop up, by applying the death penalty to rapists and child molesters. It may not deter anyone else, but it insures, that one will never harm an other innocent. Pedaphiles are notorious repeat offenders.
This counters everything you have just said. Cashman was notorious for these kinds of actions. You cannot be on both sides.
