Well, Adam Schiff has said this several times actually including during the Senate hearing. Problem is, the Republican argument is that the Constitution is just something you wipe your ass with not something that dictates any sort of rules, law, or order.
Lawyers like to invent this stuff and then they will argue until the end of time that the Constitution does not matter and if you want to challenge that...we'll see you in court. Hence why it is so important to stuff the courts with judges that believe what Nixon said is the absolute truth..."If the president does it, it is not illegal."
