One interesting aspect of what the Colorado Supreme Court sent to the US Supreme Court is they quoted Neil Gorsuch in their brief. Gorsuch has already weighed in on this topic when he was a circuit court judge and his opinion then was the state has the right to remove a person from the ballot if it is determined they have committed an act or acts that disqualify them. If Gorsuch stands by what he has already written on this, he would support Colorado's ruling.
The thing is, Gorsuch probably now believes, screw state's rights in this case, we must intervene and overrule the state.
What shady Neil once thought:
"As then-Judge Gorsuch recognized in Hassan, it is 'a state's legitimate interest in protecting the integrity and practical functioning of the political process' that 'permits it to exclude from the ballot candidates who are constitutionally prohibited from assuming office,'"
