Think about it -
The initial prisoners were shippped to Gitmo (Not on our shores, leased land that is not technically a US Base)
We never declared war against Afganistan, Al_Quida or Iraq Specifically, instead we declared War on an adverb. (Leading to the legally nebules "Enemy Combatant")
The Abu Grav prison is not an army base (See Gitmo)
The Interrigation was directed primarily by CIA and Mercinaries (can we dispense with Contractors, please??) who are not Subject to military law.
This was set up to give the administration maximum wiggle room and plausable deniability for the eventual Fan Spray O' Shit. The Wurlitzer is cranking at full steam with finger pointing and parsing, the least of which was Limbaugh's Frat Hazing line - and don't even get me started on Coulter's "Women are too Vicious too be in combat" line.
