So, watching the court side of things for Trump is interesting, because everybody wonders if or how it will impact his campaign to get reelected. It has been confusing to watch, mainly because there is only one discernible real strategy his lawyers want to use in all the cases which is to find any possible way to delay anything and everything until after the election, because if Republicans regain control of both houses and a Republican gets elected president, they would then fire Jack Smith and begin attempting to prosecute anybody they perceive as threat to stopping their plan to turn the US into a fascist country. Trump claims he will have Smith locked up in a mental institution once reelected.
So, we are up against a ticking clock, in that, you do want to get the federal trials going before the election. On the state cases, if Trump were to get reelected, he would then declare himself immune to any prosecution, anywhere.
So, number one strategy for Trump's lawyers is run out the clock and they are doing their best to do that. Does not matter what happens, they will challenge, file an appeal, file for a delay, file to have a judge removed, file to wait until there is a ruling on any filing they make before anything can proceed. Essentially, to get a trial going against Trump, you have to be prepared to prevent him from delaying it for years. Then hilariously, Trump and his attorneys will say "Why didn't they get us in court sooner? They just want this to run up against the election to interfere with the Trump campaign!"
Interestingly, in pretty much all the Trump cases they are not denying he committed the crimes, nope, instead they argue bizarre things like "as president, Trump was not required to defend or uphold the Constitution nor did he swear an oath to do so" or "Trump has immunity here because if the president does it, it is not illegal" (thanks Richard Nixon), and most bizarre "Yeah, I committed these crimes but everybody is bias and against me so I can't get a fair trial, so throw this out!"
In other words, in these "arguments" they are not using any legal basis, they are making political arguments for the media and to be repeated to his followers on Truth Social.
They have no defense, which is why their court strategy looks like a crazy clown show. They know they are going to lose these cases, because there is a mountain of evidence in all of them, and they have no way to defend what was done, so his lawyers are actually just making as much noise for Trump fans as they can, and they will take the court losses they know are coming and appeal them. Then the show starts all over again. They immediately claim they lost because the judges, clerks, people that worked for Trump, Republicans, they were all biased and out to get him.
Trump and his lawyers can't win in court because in court you have to present evidence...they have none and are not presenting any, while the other side, the prosecutors have mountains of it and it all comes from other Republicans and people that worked with and for Trump.
So, his lawyers have to play Trump's game, cry foul, claim bias, delay, and hope they don't eventually get charged with anything because his lawyers typically do.
Trump is getting all kinds of special treatment in court, they basically let him get away with anything, because he is a wealthy former president and nobody wants to open the door to a bias claim. Trump knows this and takes full advantage of it. So, anybody else that made the kind of threats he does and slanders court employees, would end up sitting in jail waiting for his trial. Trump knows they won't do that to him, so, he just ignores them.
In a democracy there are all these gentleman's rules and agreements, and Trump has shown they exist in the justice system too. So, everybody plays by the gentleman's rules and agreements...except Trump, because he is no gentleman. He plays by Fuck You rules, meaning no matter what anybody does or says, he just says "Fuck you, make me!"
He will exploit that weakness as long as we let him and his followers read that as strength.
